AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "Advocate," or "Prospect") and Rakefire LLC ("Company," "we," "us," or "our"), the builder and operator of the Stoked platform, regarding your access to and use of the Stoked community web application and any related media, content, or communications (collectively, the "Platform").

You are accessing this Platform as a member of the Rakefire community. The Platform is operated by Rakefire LLC on behalf of, and in coordination with, Rakefire ("Brand"). Your experience, community, and interactions within this Platform are sponsored and administered by the Brand, but the underlying technology is provided by Rakefire LLC.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DISCONTINUE USE IMMEDIATELY.

WHO THIS APPLIES TO

These Terms apply to two types of users:

Advocates — individuals who have been invited to or joined the Rakefire community through the Stoked platform to share their experiences, provide referrals, and engage with the Brand.
Prospects — individuals who have been referred to or discovered the Rakefire community and are exploring participation on the Platform.

Both Advocates and Prospects are subject to these Terms.

THE PLATFORM AND YOUR RELATIONSHIP WITH THE BRAND

Stoked is a community and advocacy platform built and operated by Rakefire LLC. When you use this Platform, you are participating in a community experience that is:

Powered by Stoked, a product of Rakefire LLC
Operated on behalf of Rakefire, who has engaged Rakefire LLC to manage and run this community experience
Coordinated with Rakefire to deliver rewards, communications, and community programming

Rakefire LLC acts as a technology provider and operator. Rakefire is responsible for the community content, rewards, and offers made available to you. Questions specific to the Brand's products, offers, or rewards should be directed to the Brand's support team.

For purposes of applicable data protection law, Rakefire acts as the data controller for your community data — meaning they determine the purposes for which your personal information is used within their community. Rakefire LLC acts as the data processor — meaning we process your data on the Brand's behalf, under their instructions, using the Stoked platform infrastructure. If you have questions about how your data is used within the Rakefire community specifically, please contact the Brand's support team. If you have questions about the platform infrastructure and technology, contact support@rakefire.io.

PRIVACY POLICY

Your privacy matters. Our Privacy Policy describes how we collect, use, and protect your information. By using the Platform, you agree to the terms of our Privacy Policy, available at: https://rakefire.stokedhq.com/privacy.

TEXT MESSAGE COMMUNICATIONS

By registering for or using the Platform, you expressly consent to receive text messages (SMS/MMS) from Rakefire LLC and/or Rakefire related to:

Community updates and announcements
Reward and referral notifications
Campaign or advocacy invitations
Platform activity and reminders

You may opt out at any time by replying STOP to any text message you receive. After opting out, you will receive one confirmation message and no further texts will be sent, unless you re-opt in.

Message and data rates may apply. Message frequency varies based on your activity and the Brand's campaigns.

Our text messaging practices are governed in accordance with applicable regulations and Twilio's Messaging Policy. We use Twilio as our SMS infrastructure provider.

NO FEES OR SUBSCRIPTIONS

The Stoked Platform is free to use for Advocates and Prospects. There are no individual subscriptions, membership fees, or charges to access or participate in the Platform. Any rewards, offers, or incentives available to you are provided at the discretion of Rakefire.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, all content, software, designs, trademarks, logos, and materials on the Platform ("Content") are owned or licensed by Rakefire LLC and are protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial participation in the Rakefire community. You may not copy, reproduce, sell, or exploit any Content without prior written permission from Rakefire LLC.

USER REPRESENTATIONS

By using the Platform, you represent and warrant that:

Any information you provide during registration is accurate and current.
You have the legal capacity to agree to these Terms.
You affirmatively represent that you are at least 18 years of age. If you are between 13 and 17 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and is aware of your participation. If you are under 13, you may not use this Platform under any circumstances. Rakefire LLC reserves the right to terminate any account we reasonably believe belongs to a user under 13 without prior notice.
You will not use automated tools (bots, scripts, etc.) to access or manipulate the Platform.
You will not use the Platform for any unlawful, deceptive, or harmful purpose.
Your use of the Platform complies with all applicable laws and regulations.

USER REGISTRATION

You may be required to create an account to participate in the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at support@rakefire.io if you believe your account has been compromised.

Minor Users

If a user is identified or self-reported as being under 18, we will limit data collection to only what is necessary for Platform participation and will not use that user's data for marketing purposes without verified parental consent.

USER-GENERATED CONTENT

When you voluntarily submit content to the Platform — including photos, testimonials, reviews, or referral messages ("User Content") — you will be presented with a clear, separate consent prompt at the time of submission asking whether you agree to allow Rakefire and/or Rakefire LLC to use that content for marketing and community purposes. You are not required to consent to marketing use to participate in the community. If you consent, you grant Rakefire LLC and Rakefire a non-exclusive, royalty-free, revocable license to use, display, and promote that specific submission. You may withdraw consent for future use by contacting support@rakefire.io, though content already published may not be retroactively removable. Rakefire LLC will never sell your User Content to third parties.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Rakefire LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
Our total liability to you will not exceed $100 USD, given that the Platform is provided to you at no cost.
We do not guarantee uninterrupted or error-free service.

Some jurisdictions do not allow certain liability exclusions, so these limitations may not fully apply to you.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Athens County, Ohio.

DISPUTE RESOLUTION

Informal Resolution

Before pursuing formal action, both parties agree to attempt to resolve any disputes informally for at least 30 days by contacting support@rakefire.io.

Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Athens County, Ohio, United States.

Small Claims Exception: Either party may bring claims in small claims court for qualifying disputes.

SERVICE AVAILABILITY & TERMINATION

We reserve the right to modify, suspend, or discontinue the Platform at any time. If Rakefire LLC terminates the Platform entirely, we will provide reasonable advance notice. You may also stop using the Platform at any time.

MODIFICATIONS TO THESE TERMS

We may update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
